POINT RESCUE CPR — MASTER TERMS OF USE & TRAINING POLICIES

By enrolling in a course, attending training, receiving credentials, making a purchase from Point Rescue CPR, or using this website, you agree to the following legally binding Terms of Use and Policies.

These policies are designed to uphold safety, instructional quality, certification integrity, compliance with credentialing agencies, and to establish clear expectations between Point Rescue CPR (“we,” “our,” “us”) and the student/participant (“you,” “your,” “student”).

1. DEFINITIONS

For purposes of this agreement:

  • “Course” refers to any class, training, certification, workshop, or service offered by Point Rescue CPR

  • “AHA” refers to the American Heart Association

  • “Credentials” refers to e-cards, certificates, CEUs, and any documentation issued to verify course completion

  • “Digital Delivery” refers to electronic transmission via email or online portal (ex: Heart.org)

  • “Force Majeure” refers to events beyond reasonable control (ex: emergency, illness, weather, disaster)

  • “Chargeback” refers to a consumer-initiated payment reversal through a financial institution

  • “No-Show” refers to a failure to attend a scheduled course without notice

  • “Student” refers to the individual enrolled in a course

2. ACCEPTANCE OF TERMS

You acknowledge acceptance of this agreement when you:

  • register for a course

  • complete payment

  • attend training (in-person or online)

  • receive credentials

  • use this website or receive services

  • or otherwise engage with Point Rescue CPR

These actions constitute a binding agreement.

3. INTELLECTUAL PROPERTY

All content on this website, including text, graphics, photos, training materials, course outlines, and media is the property of Point Rescue CPR unless otherwise noted. It may not be reproduced, distributed, or reverse-engineered without written permission.

4. INFORMATIONAL & MEDICAL DISCLAIMER

Training is educational and not a substitute for medical care. Real-world emergencies can vary. Completion of training does not guarantee specific outcomes.

CPR and emergency response training involves physical activity, including kneeling, bending, and chest compressions. Students are responsible for assessing their own physical ability and may consult a physician before participating. We are not liable for injuries or limitations arising from participation.

Always call 911 in emergencies.

5. THIRD-PARTY LINKS

We may link to external sites for convenience. Such links are not endorsements. We are not responsible for content on external websites.

6. PRICING, BILLING & PAYMENT AUTHORIZATION

Pricing is subject to change without notice. Third-party listings (search engines, directories, partner platforms) may display outdated or inaccurate pricing. Only prices provided directly by Point Rescue CPR are valid.

By submitting payment, you authorize Point Rescue CPR to charge the method provided for all associated fees.

Tuition is not contingent upon employment, licensing, hiring, or credential acceptance by any employer, agency, or organization.

7. NO REFUND POLICY (NON-REFUNDABLE TUITION)

All courses, products, and combinations are NON-REFUNDABLE without exception.

This includes but is not limited to:

  • registration errors

  • personal emergencies

  • scheduling conflicts

  • employer changes

  • dissatisfaction after completion

  • credential acceptance issues

  • failure to attend

  • voluntary withdrawal

  • misunderstanding of requirements

Refund requests will not be honored under any circumstances.

8. RESCHEDULING POLICY & NO-SHOWS

Rescheduling is a courtesy, not guaranteed.

Student-Initiated Reschedule:

  • Allowed only with minimum 24-hour advance notice

Late Notice or No-Show:

  • Student may receive one courtesy reschedule at the discretion of the instructor

  • After courtesy reschedule, a new registration must be purchased

No refunds will be issued due to lateness, no-shows, emergencies, or scheduling conflicts.

9. LATE ARRIVAL POLICY

Due to sequential skill instruction, students arriving more than 10 minutes late may be denied entry.

Denied entry due to lateness follows the same reschedule rules above. Tuition remains non-refundable.

10. ATTENDANCE & GUEST POLICY

To maintain safety and instructional integrity:

  1. Only registered, paid students may participate.

  2. Guests (including children, family, or observers) may be permitted only with prior instructor approval before class begins.

  3. Unapproved guests may be asked to leave immediately.

  4. Certification is awarded only to students who attend the full course and meet all performance requirements.

11. STUDENT CONDUCT & SAFETY POLICY

Students must conduct themselves respectfully toward instructors and peers. Disruptive, aggressive, threatening, harassing, or unsafe behavior may result in removal without refund and denial of certification.

Weapons, illegal drugs, or intoxication are strictly prohibited during training.

12. ACCOMMODATIONS & SKILL LIMITATIONS

Point Rescue CPR does not collect medical or health information and does not provide accommodations that alter skill performance requirements required for certification.

Classroom accommodations (seating, lighting, etc.) may be provided when reasonable and safe. Skill performance accommodations (ex: compressions performed by another person) are not permitted due to credentialing standards.

For courses requiring physical skill performance (including CPR), students who are unable to perform required skills will not receive certification.

13. INSTRUCTOR AUTHORITY

Instructors have full authority to:

  • remove disruptive students

  • deny certification

  • require rescheduling

  • restrict guest access

  • enforce safety protocols

  • halt training due to hazard or medical event

Instructor decisions regarding certification are final.

14. DIGITAL CREDENTIAL DELIVERY POLICY

Credentials are issued electronically via email or portal. Credentials are considered delivered and accepted when any of the following occur:

  1. sent to the email address provided by the student

  2. accessed via Heart.org or other issuing platform

  3. successfully claimed by the student

  4. downloaded, printed, or forwarded

  5. used for employment or compliance purposes

Students are responsible for checking spam/junk folders and providing a valid email. Email filtering does not constitute non-delivery.

15. CERTIFICATION ISSUANCE & COMPLETION POLICY

Certification requires:

  • full attendance

  • successful skill demonstration

  • instructor evaluation

  • roster validation

For AHA courses:

  • students must claim e-cards via Heart.org

  • successful claim = full completion of services

  • claimed cards are non-revocable by Point Rescue CPR

For non-AHA courses (ex: EKG), certificates are delivered via email and delivery constitutes completion.

CEUs: CEUs for eligible courses are claimed directly through the AHA portal.

16. NON-AHA CERTIFICATE REVOCATION

We reserve the right to revoke non-AHA credentials (e.g., EKG, CE certificates) for:

  • non-payment

  • chargeback abuse

  • fraud

  • identity misrepresentation

  • credential misuse

17. EMPLOYER / AGENCY ACCEPTANCE

It is the student’s responsibility to verify that a course meets employer, agency, licensure, or regulatory requirements before enrolling.

Refunds are not issued for employer rejection, requirement mismatches, or misunderstanding of credential needs.

18. CHARGEBACK ABUSE & COLLECTIONS

Filing false chargebacks (“friendly fraud”) constitutes theft of service.

Point Rescue CPR reserves the right to:

  • submit evidence to banks

  • permanently block future enrollments

  • revoke non-AHA certificates

  • invoice outstanding balances

  • pursue collections for unpaid balances

Once credentials are issued or claimed, chargebacks for “non-receipt” are invalid.

19. PHOTOGRAPHY, FILMING & SECURITY MONITORING

Training facilities may utilize photography, video, and security monitoring for safety and operational purposes. Students may request not to appear in promotional content before class and reasonable efforts will be made to accommodate.

20. FORCE MAJEURE & EMERGENCY CLOSURES

Classes may be delayed or rescheduled due to:

  • illness

  • instructor emergency

  • weather

  • facility issues

  • disaster

  • safety concerns

Such events do not entitle students to refunds, only rescheduling.

21. LIABILITY LIMITATION & ASSUMPTION OF RISK

By participating, you acknowledge:

  • physical activity risks

  • training-associated risks

  • assumption of responsibility for personal health conditions

To the fullest extent permitted by law, Point Rescue CPR is not liable for injuries, health complications, or indirect damages arising from participation.

22. INDEMNIFICATION

You agree to indemnify and hold harmless Point Rescue CPR, its owners, instructors, and affiliates from claims arising out of misuse of training, credential use, or violation of these terms.

23. GOVERNING LAW

These terms are governed by the laws of the State of California.

24. MANDATORY ARBITRATION & CLASS ACTION WAIVER

Any dispute arising from these terms, including tuition, credentialing, or participation, shall be resolved through binding arbitration in California.

Students waive the right to:

  • participate in class actions

  • pursue litigation in civil court

  • pursue jury trials

Arbitration decisions are final.

25. SEVERABILITY

If any provision is deemed unenforceable, the remaining terms remain in effect.

26. ENTIRE AGREEMENT

These terms constitute the full agreement between the parties and supersede all prior communications.

27. ACCEPTANCE OF TERMS

By registering for a course, submitting payment, participating in training, receiving credentials, or using this website, you agree to all terms above.
